    I have had an email saying that a company has applied for the internet trademark of the same as my company name.

    Dear CEO,

    We have something important to confirm with your company.
    On the Nov 3, 2008, we received an application formally from one company named "AnLan international Holdings Ltd" who applied for the Internet trademark: "******hosting**" and some domain names relevant to this trademark from our organization.


    After our initial examination, we found that the Internet trademark and domain names applied for registration are as same as your company's name and trademark.These days we are dealing with it, so we hope to get assistant from your company.

    Considering this issue will relate to your intellectual property, now we have not finished the registration of AnLan company yet,in order to deal with this issue better,Please forward this email to the person who can be in charge and contact us in time.Thank you!

    The company is "Best web service company limited"

    Has anyone else had any dealings like this and what can I do to protect my company, domain names.

    I have worked hard to build up the site and company name and have managed to get it to list high in google for searches for web hosting.

    The Loon, the style and punctuation of this email do not appear to be very professional. Furthermore, the sender had not signed his/her family name. So it could be a scam.

    I suggest that you do some research about both "AnLan international Holdings Ltd" and "Best web service company limited". You could also consult with a lawyer, if you think that the threat is serious.

      Domain Name Scam

      I have looked into "Best web service company limited" and all I can find is scams associated with this company.

      This seems to be a generic letter sent out by a large number of these scam companies.

      I will list these companies for anyone else who might receive one of these emails.

      • West Technology Limited
      • Govdm information technology Ltd

      There are many more, some even come with a follow-up letter if you don't reply.

        What is an "Internet trademark"?
        I have never heard of this before?

        If it is real who controls Internet trademarks?
        If it is fake then we should add this to the list of "scams".

          Thanks guys! I think it's fraud.

          And you know what, I've called their number 00852-9566-0489 in Hong Kong and asked for Camille. The call was answered by the guy with proper English and said that Camille is out of the office.

          Also it's very suspicious that they suggest to pay 129 EUR per year for registration of Internet trademark. I've asked them why it's not one off payment and waiting for replay.

          Due to the crisis lots of fraud makers are looking for opportunity to make money like this.

            I've never recieved anyhting like this before. I will keep a lookout for things like it.

              Internet Trademarks

              Because of the increasing popularity of the Internet, companies have realized that having a domain name that is the same as the company or product name can be an important part of establishing an Internet presence. However, when companies attempt to obtain their desired domain name, they may discover that their desired domain name is already taken. When this happens, the company can either choose a different name or fight to get the domain name it really wanted.

              These fights are called domain name disputes.

              A Couple of examples:

              mcdonalds.com: This domain name was taken by an author from Wired magazine who was writing a story on the value of domain names. In his article, the author requested that people contact him at ronald @ mcdonalds.com with suggestions of what to do with the domain name. In exchange for returning the domain name to McDonalds, the author convinced the company to make a charitable contribution.

              micros0ft.com: The company Zero Micro Software obtained a registration for micros0ft.com (with a zero in place of the second 'o'), but the registration was suspended after Microsoft filed a protest. When the domain name went abandoned for non-payment of fees, the domain name was picked up by someone else: Vision Enterprises of Roanoke, TX.

              candyland.com: Both Hasbro and an adult entertainment provider desired the candyland.com domain name. Hasbro was too late to register the name itself, but it is never too late to sue (well, almost never). The domain name is now safely in the hands of Hasbro.

                Domain name scam?

                Hi:

                I've received no less than 5 follow-up e-mails from Ben@govdm.com advising that a particular company wants to buy www.leathertherapy.hk. Same scenario as some of the others you've already printed. Just decided to conduct a search before I gave my credit card info. Up your site popped! Thank you very much.

                I found reference to Govdm Information Technology Limited listed as a scam, however their website is impressive -- yet I need to protect my LeatherTherapy brand name worldwide.

                FYI, my brand is trademarked in most parts of the world -- except Japan,China, HK. I've got my lawyer working on that now but figured I should buy the mark to secure the name.

                Advice please?

                  Anna, this is a web hosting forum, not a legal advice forum. Your lawyer is the one who can advise you best on this matter.

                  I can only advise you to stay vigilant and investigate prior to paying anything, if you have even the slightest doubts that you might be scammed.

                    All the site related to this scam look very impressive, but all contain the same content. They claim to have worked for big companies such as Swatch Group, Bayer AG, Allianz, ING Group, HSBC Group, Budweiser and may others.

                    Bellow is an extract from the ICANN website and I think you will find it on this site in the Terms of Service

                    Applicable Disputes. You are required to submit to a mandatory administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

                    (i) your domain name is identical or confusingly similar to a trademark or service mark in which the complainant has rights; and

                    (ii) you have no rights or legitimate interests in respect of the domain name; and

                    In the administrative proceeding, the complainant must prove that each of these three elements are present.
                    After reading this, it could sound as if it doesn't matter if a company registers a trade mark if you already own the domain name you HAVE legitimate interests in respect of the domain name. I am no internet law guru and as Milen said "this is a web hosting forum, not a legal advice forum", but after reading this I feel happier.
